UK court agrees Assange extradition to Sweden

(Reuters) – A British court agreed on Thursday to extradite WikiLeaks founder Julian Assange to where he is wanted for questioning over sex crimes, dismissing claims the move would breach his human rights.

Swedish prosecutors want to Assange about allegations of sexual misconduct, which he denies, made by two WikiLeaks volunteers during his time in Sweden last August.

“I have specifically considered whether the physical or mental condition of the defendant is such that it would be unjust or oppressive to extradite him,” Judge Howard Riddle told ’s top-security Belmarsh Magistrates’ Court.

“I am satisfied that extradition is compatible with the defendant’s (European) Convention rights, I must order Mr Assange be extradited to Sweden.”

Lawyers for Assange, who has angered the by releasing thousands of secret U.S. diplomatic cables on his , said they would against the decision at London’s High Court, putting the extradition on hold.

Mark Stephens, a lawyer for Assange, said the case showed that extraditions under the fast-track European arrest warrant were a form of “tick-box justice”.

“We are still hopeful that the matter will be resolved in this country. We still remain very optimistic about our opportunities on appeal,” he told reporters outside court.

One of the alleged victims accuses Assange of sexually molesting her by ignoring her request for him to use a during sex. The second woman has said Assange had sex with her while she was asleep and that he was not wearing a .

Prosecutors say the second allegation falls into the least severe of three categories of rape in Sweden, carrying a maximum of four years in jail.

Assange is a controversial and flamboyant character who inspires strong loyalties among his supporters, but his former right-hand man described him in a recent book as an irresponsible, autocratic bully.

Scores of reporters from around the world have covered the court case and celebrities including British film director Ken Loach and Australian journalist John Pilger offered sureties in December to persuade the British court he would not abscond.

FAIR TRIAL

During three days of legal argument earlier this month, lawyers for Assange argued he would not get a fair trial in Sweden and said Swedish prosecutors had mishandled the case against the 39-year-old Australian computer expert.

They argued that he might wind up being sent to the where he could face execution for leaking secrets.

Assange’s lawyers also accused Sweden’s Fredrik Reinfeldt of creating a “toxic atmosphere” in Sweden and damaging his chances of a fair trial by portraying him as “public enemy number one”.

However, Judge Riddle dismissed each of the defense’s arguments in turn, even describing Assange’s Swedish defense lawyer as an “unreliable witness”.

The judge said Swedish prosecutors had tried to interview Assange before he left the country but had been unable to do so.

He said the European arrest warrant, under which the fast-track extradition request as made, was valid and the alleged crimes were serious. Publicity surrounding the case was also not a reason to refuse extradition.

“I think it is highly unlikely that any comment has been made with a view to interfere with the course of public justice,” Riddle said.

The Swedish prosecution authority had no immediate comment.

U.S. Gov. Mistakenly Shutters 84,000 Websites for Child Porn

04b617c122da0706035860df28baba21 U.S. Gov. Mistakenly Shutters 84,000 Websites for Child Porn

CYBERSPACE—Anyone want to bet that that the will never again mistakenly shutter websites it believes are involved in illegal activity? I didn’t think so. As Homeland and the Department of Justice, by way of Immigration and Customs Enforcement (ICE), become more aggressive in their determination to take offline websites that deal in counterfeit goods and child , innocent operators are being swept up in the net.

In the latest snafu, TorrentFreak has reported that last Friday 84,000 site owners were “surprised by a rather worrying banner that was placed on their domain.”

A message on the banner read, ominously, “Advertisement, distribution, transportation, receipt, and possession of child pornography constitute federal crimes that carry penalties for first time offenders of up to 30 years in federal prison, a $250,000 fine, forfeiture and restitution.”

Unfortunately for everyone involved, the 84,000 sites were not involved in child pornography, but were simply hosted by a large DNS service provider.

“The domain in question is mooo.com, which belongs to the DNS provider FreeDNS,” reported TorrentFreak. “It is the most popular shared domain at afraid.org and as a result of the authorities’ actions a massive 84,000 subdomains were wrongfully seized as well. All sites were redirected to the banner below.

“The FreeDNS owner was taken by surprise and quickly released the following statement on their website. ‘Freedns.afraid.org has never allowed this type of abuse of its DNS service. We are working to get the issue sorted as quickly as possible.’”

By , most of the domains are back online, but the residual effects of being targeted by your own government for a you did not commit has domain owners are feeling understandable skittish, and even defensive. One posted the following message in reaction.

“One of the customers quickly went out to assure visitors that his site was not involved in any of the alleged crimes.

“You can rest assured that I have not and would never be found to be trafficking in such distasteful and horrific content,” the site owner wrote. “A little sleuthing shows that the whole of the mooo.com TLD is impacted. At first, the legitimacy of the alerts seems to be questionable—after all, what reputable agency would display their warning in a fancily formatted image referenced by the underlying HTML? I wouldn’t expect to see that.”

As for the law enforcement agencies presumably responsible for the error, an does not seem to be forthcoming, or even an acknowledgement that anything went wrong. A press release posted to the Homeland security website Tuesday serves up bucketfuls of self-congratulations for taking 10 websites offline, but makes no mention of the 84,000 sites.

“For all its positive impact, the has also unfortunately created a new way for child predators to commit their inexcusable crimes,” Assistant Attorney General Lanny A. Breuer of the U.S. Department of Justice, Criminal Division is quoted as saying. “The production and distribution of child pornography wreak havoc on innocent lives. With these domain seizures, we are taking our fight against child pornography to websites that facilitate the exchange of these abusive images.”

False accusations wreak peoples’ lives, too, but the government must be saving that warning for a later press release.

Assange lawyer says Swedish PM prejudices case

5956d747c3acdec4437fd30cff1c9a8a Assange lawyer says Swedish PM prejudices case

(Reuters) – A lawyer for WikiLeaks founder Julian Assange accused ’s prime minister on Friday of damaging his client’s chances of a fair trial for alleged sex crimes by portraying him as “public enemy number one.”

Assange’s lawyer Geoffrey Robertson, opposing a Swedish bid to extradite the Australian from , said Prime Minister Fredrik Reinfeldt had created a “toxic atmosphere” with what he said was an inflammatory statement about Assange and his lawyers.

A three-day hearing at the top- Belmarsh Magistrates’ Court, southeast , was adjourned until February 24, when Judge Howard Riddle is expected to rule whether Assange may be extradited.

Assange, a 39-year-old computer expert who has angered the government by releasing thousands of secret diplomatic cables on his website, is wanted in Sweden to face allegations by two WikiLeaks volunteers of sexual misconduct during a visit there last August.

Riddle rejected Robertson’s request to be given more time to present evidence of the damage he said comments by Reinfeldt and other Swedish politicians had done to Assange’s ability to get a fair trial.

On Tuesday, Reinfeldt hit out at criticism, made during the Assange hearing, of his country’s legal system, and described the allegations against the WikiLeaks founder as “very serious.”

ENEMY OF THE PEOPLE

Robertson said Swedes viewed Assange as “public enemy number one as a result of the prime minister’s statement.” Assange “has in effect been denounced as an ‘enemy of the people’,” he said.

He accused Reinfeldt of issuing “distortions and falsehoods” about Assange’s case and of showing contempt for the presumption that a defendant is innocent until proven guilty.

“In a small country — Sweden has only nine million people — it has created, we understand, a toxic atmosphere,” he said.

Prosecutor Clare Montgomery said Reinfeldt’s comments appeared to be a reaction to media briefing by the defense team. “Those who hope to fan the flames of the media firestorm can’t be too surprised when they get burned,” she told the court.

Assange’s lawyers argue that transfer to Sweden could be a stepping stone to extradition to the , where they say he could end up facing execution for leaking secrets.

The defense says Assange’s rights would be violated because Swedish trials are usually held in private. It says Swedish prosecutors could have had Assange questioned in Britain rather than seeking his extradition.

The prosecution says Assange did not cooperate with attempts by Swedish prosecutors to interview him and that questioning him in Britain would not be appropriate.

Assange has been free, but under strict conditions, since a British court released him on bail in December. The U.S. government is examining whether criminal charges can be brought against him over the diplomatic cables.

WikiLeaks’ Assange fights extradition to Sweden

(Reuters) – WikiLeaks founder Julian Assange will try to persuade a British judge Monday to block his extradition to Sweden to face trial for crimes, arguing he could end up facing execution in the .

The 39-year-old Australian computer expert, who has infuriated the by releasing thousands of secret diplomatic cables on his website, is wanted in Sweden where two WikiLeaks volunteers allege sexual misconduct. Assange denies the allegations.

At a two-day hearing starting Monday at the high Belmarsh Magistrates’ Court in southeast , Assange’s lawyers will try to persuade Judge Howard Riddle to refuse the Swedish extradition request.

Sweden is seeking Assange’s extradition under a European arrest warrant, introduced in 2004 to speed up extraditions between European Union member states.

Grounds for refusing a request are limited, mainly to whether extradition would violate a suspect’s rights or whether the arrest warrant was drawn up correctly.

Riddle will not look at the strength of the evidence against Assange, who has been living at a supporter’s mansion under a form of house arrest since a court granted him bail in December.

In an outline of their case posted on the Internet, Assange’s lawyers argue that the arrest warrant was issued to punish him for his political opinions and sending him to Sweden could be a stepping stone to a transfer to the United States.

ASSANGE RAISES RENDITION FEAR

“There is a real risk that, if extradited to Sweden, the will seek his extradition and/or illegal rendition to the USA, where there will be a real risk of him being detained at Guantanamo Bay or elsewhere …,” the document said.

“Indeed, if Mr. Assange were rendered to the USA … there is a real risk that he could be made subject to the death penalty,” it said.

The U.S. government is examining whether criminal charges can be brought against Assange over the publication of the diplomatic cables which disclosed sensitive information such as that Saudi King Abdullah repeatedly urged the United States to attack Iran’s nuclear program.

Secretary of State Hillary has said the U.S. government will take aggressive steps to hold responsible those who “stole” the cables, saying the leaks put lives in danger and threatened U.S. .

Assange has also attracted supporters, including activists, celebrities and politicians. A Norwegian politician said last week he had nominated WikiLeaks for the 2011 Nobel peace prize.

Lawyer Gemma Lindfield, representing Swedish judicial authorities, told an earlier court hearing in London that the extradition case contained allegations of four sexual assaults by Assange against two women in Stockholm in August 2010.

One accusation by “Miss A” is that Assange “sexually molested her” by ignoring her request for him to use a condom when having sex with her.

Another relates to “Miss W,” who says Assange had sex with her without a condom while she was asleep. Prosecutors say that amounts to the least severe of three categories of rape in Sweden, carrying a maximum of four years in jail.

If the court rules he may be extradited, Assange can appeal and the legal arguments could stretch on for months.

WikiLeaks founder says enjoys making banks squirm

NEW YORK | Fri Jan 28, 2011 7:57pm EST

NEW YORK (Reuters) – WikiLeaks founder Julian Assange says he enjoys making banks squirm thinking they might be the next targets of his which has published U.S. diplomatic and secrets.

“I think it’s great. We have all these banks squirming, thinking maybe it’s them,” Assange told the CBS program “60 Minutes” in an interview.

CBS released a partial transcript on Friday ahead of Sunday’s broadcast of the full segment.

Bank of America Corp shares fell more than 3 percent on Nov. 30 on investor fears that the largest U.S. bank by assets would be the subject of a document release.

Interviewer Steve Kroft asked Assange whether he had acquired a five-gigabyte hard drive belonging to one of the bank’s executives, as Assange had previously asserted.

“I won’t make any comment in relation to that upcoming publication,” said Assange, who is under a form of modified house arrest in , awaiting an extradition hearing to Sweden for questioning over alleged sex offenses that he denies.

Assange had told Forbes magazine that WikiLeaks planned a “megaleak” by releasing tens of thousands of internal documents from a major U.S. bank in early 2011 that he expected would lead to investigations of the bank.

In an October 2009 interview, Assange told Computerworld that WikiLeaks had obtained five gigabytes of data from a Bank of America executive’s hard drive.

The Forbes interview came just after WikiLeaks released 250,000 U.S. diplomatic cables. Previously, WikiLeaks had made public nearly 500,000 classified U.S. files on the wars in and Afghanistan.

Major headlines were generated by some of the cables, which revealed that Saudi leaders had urged U.S. military action against Iran and detailed contacts between U.S. diplomats and political dissidents and opposition leaders in some countries.

Assange told “60 Minutes” he fully expected U.S. retaliation but that the American government was incapable of taking his website down.

“The U.S. does not have the technology to take the site down . … Just the way our technology is constructed, the way the is constructed,” Assange said.

“We’ve had attacks on particular domain names. Little pieces of infrastructure knocked out. But we now have some 2,000 fully independent in every way websites, where we’re around the world. It is — I mean, it’s not possible to do.”

WikiLeaks says it is a nonprofit organization funded by campaigners, journalists and the general public. Launched in 2006, it promotes the leaking of information to fight government and corporate corruption.

Martin Luther King Holiday – MLK was a religious visionary, too

8da6b13241e7c49c0898b2eb4bf066bf Martin Luther King Holiday – MLK was a religious visionary, too

One hundred years ago, the great African-American scholar W.E.B. DuBois famously wrote, “The problem of the 20th century will be the problem of the color line.”

History proved DuBois correct. His century saw the struggles against, and ultimately the victory over, systems that separated and subjugated people based on race — from colonialism in India, to Jim Crow in the U.S., to apartheid in South Africa.

No American did more than Martin Luther King Jr. — whom America pauses to honor today — to address the problem of the color line. He spearheaded the marches that revealed the brutality of segregation, made speeches that reminded Americans that the promise of their nation applied to all citizens and expertly pressured the nation’s leaders in Washington to pass landmark civil rights legislation.

But to confine King’s role in history only to the color line — as giant as that challenge is, and as dramatic as King’s contribution was — is to reduce his greatness. In one of his final books, Where Do We Go From Here: Chaos or Community, King showed that race was one part of his broader concern with relations at large: “This is the great new problem of mankind. We have inherited … a great ‘world house’ in which we have to live together — black and white, Easterner and Westerner, Gentile and Jew, Catholic and Protestant, Muslim and Hindu … Because we can never again live apart, we must learn somehow to live with each other in peace.”

This ethos, as King’s examples make clear, applies not only to the question of race, but to faith as well. In the same way as the headlines of the 20th century read of conflict between races, headlines in our times are full of violence between people of different religions. Indeed, what the color line was to the 20th century, the faith line might be to the 21st.

Faith as a bridge

King’s life has as much to say to us on the question of interfaith cooperation as it did on the matter of interracial harmony. A prince of the black church, deeply rooted in his own Baptist tradition, King viewed his faith as a bridge of cooperation rather than a barrier of division.

When, as a seminary student, King was introduced to the satyagraha (“-force”) philosophy of the Indian Hindu leader Mahatma Gandhi, King did not reject it because it came from a different religion. Instead, he sought to find resonances between Gandhi’s Hinduism and his own interpretation of Christianity. Indeed, it was Gandhi’s movement in India that provided King with a 20th century version of what Jesus would do. King patterned nearly all the strategy and tactics of the civil rights movement — from boycotts to marches to readily accepting jail time — after Gandhi’s leadership in India. King called Gandhi “the first person in history to lift the ethic of Jesus above mere interaction between individuals to a powerful and effective social force.”

Following Gandhi was King’s first step on a long journey of learning about the shared social justice values across the world’s religions, and partnering with faith leaders of all backgrounds in the struggle for civil rights. In 1959, more than a decade after the Mahatma’s death, King traveled to India to meet with people continuing the work Gandhi had started. He was surprised and inspired to meet Indians of all faith backgrounds working for equality and harmony, discovering in their own traditions the same inspiration for love and peace that King found in Christianity.

King’s experience with religious diversity in India shaped the rest of his life. He readily formed a friendship with the Rabbi Abraham Joshua Heschel, finding a common bond in their love of the Hebrew prophets. The two walked arm-in-arm in the famous civil rights march from Selma to Montgomery.

Later, Heschel wrote, “Our march was worship. I felt my legs were praying.”

King’s friendship with the Buddhist monk Thich Nhat Hanh inspired one of his most controversial moves, the decision to publicly oppose the Vietnam War. In his letter nominating Nhat Hanh for the Nobel Peace Prize, King wrote, “He is a holy man. … His ideas for peace, if applied, would build a monument to ecumenism, to a world brotherhood, to humanity.”

Better together

In his famous sermon “A Time to Break Silence,” King was unequivocal about his Christian commitment and at the same time summarized his view of the powerful commonality across all faiths: “This Hindu-Muslim-Christian-Jewish-Buddhist belief about ultimate reality” is that the force of love is “the supreme unifying principle of life.”

We live at a time of religious conflict abroad and religious tension at home. This would no doubt have dismayed King, who viewed faith as an inspiration to serve and connect, not to destroy and divide. During King’s time, groups ranging from white supremacists to black militants believed that the races were better apart. Today, the same is said of division along the lines of faith.

King insisted that we are always better together. Indeed, that pluralism is part of divine plan. To paraphrase one of his most enduring statements: The world is not divided between black and white or Christian and Muslim, but between those who would live together as brothers and those who would perish together as fools.

On Religion

Faith. Religion. Spirituality. Meaning.

In our ever-shrinking world, the tentacles of religion touch everything from governmental policy to individual morality to our basic social constructs. It affects the lives of people of great faith — or no faith at all.

“Racism and bigotry are no longer tolerated in this country as they once were, and the doors of opportunity stand open to children of every background,” Democratic National Committee chairman Tim Kaine said in a statement. “But we remain an imperfect nation. We must continue to strive to better ourselves and our country by upholding timeless values that Dr. King exemplified: truth, courage, compassion and justice.”

“This holiday should be one simply of quiet remembrance but of active service to those in our community who need it most, those who Dr. King would have regarded with compassion and treated with charity,” said the committee’s vice chair, Donna Brazile.

The Republican National Committee also released a statement, in which chairman Reince Priebus said King was “a leader who was committed to individual freedom and allowing every citizen the opportunity to achieve their dreams.

“America was founded on the principles of freedom and liberty for all, and the Republican Party will continue working towards ensuring every citizen in this country has an equal chance of living the American Dream,” Priebus said.

Vice President and numerous Cabinet secretaries and administration officials are also scheduled to participate in service events, the White House said.

King’s son, Martin Luther King III, is scheduled to deliver the keynote address at a memorial service at Atlanta’s Ebenezer Baptist Church.

The Rev. Al Sharpton’s National Action Network said it planned to mark the day with a breakfast in Washington and a public policy forum in New York.

In a statement Sunday, Interior Secretary Ken Salazar noted that a memorial in King’s honor is under construction on the National Mall in Washington.

“When completed later this year, the memorial will serve to remind us of Dr. King’s hope, sense of justice, and quest for equality,” he said.

A march “for jobs and justice” was scheduled to begin at the memorial site Monday and end at the Lincoln Memorial, where King delivered his famous “I Have a Dream” speech in 1963.

Pro-WikiLeaks hackers may be hard for U.S. to pursue

aceaa3c0e2eac42f737b46eaefb370e9 Pro WikiLeaks hackers may be hard for U.S. to pursue

U.S. would have to rely on other countries to cooperate

NEW YORK – Legal hurdles could make it tough for U.S. prosecutors to go after pro-WikiLeaks hackers who waged cyber attacks last week on Visa, MasterCard, PayPal and other companies.

Attorney General Eric Holder said last week he was “looking into” it but there are enormous challenges finding, moving, investigating and finally convicting those the might accuse.

Typically the federal government prosecutes hacking under the Computer Fraud and Abuse Act, which prohibits the “transmission of a program, information, code, or command” that “intentionally causes damage without authorization, to a protected computer.” It’s a broad, powerful statute that applies even to computer committed abroad, and can carry prison sentences and heavy fines. But to use it, authorities will first have to locate the elusive hackers and bring them to the United States.

In this case, a group of activists working under the name Operation Payback claimed responsibility for the attacks, which briefly shut down the websites of several companies that had cut off services to WikiLeaks after the whistleblower organization last month made public a massive trove of secret U.S. diplomatic cables. Dutch police arrested two Dutch teenagers last week, and other hackers around the globe are believed to be involved. If the U.S. seeks to prosecute these or any other hackers who may be apprehended overseas, it will have to rely on foreign counterparts to extradite them to the United States. Extraditions often get caught up in politics.

Over the last decade, international cooperation in computer crimes has increased; since 2004, dozens of countries have ratified the Council of Europe’s Convention on Cybercrime, which was designed to harmonize computer crime policy and foster international cooperation. Still, a handful of countries, including Russia, have not ratified the treaty. Prosecuting hackers in those countries could prove difficult. The Wall Street Journal reported that the Federal Bureau of Investigation worked with Dutch authorities on the arrests; Justice Department spokeswoman Laura Sweeney declined to comment on the arrests in or the extent to which the two countries may be cooperating.

The targeted companies apparently suffered “distributed denial-of-service attacks,” which overload websites with so much traffic that they slow down or stop functioning altogether. In such attacks, hackers infect many computers with a program designed to the target’s Web server. To find the people responsible, the U.S. government might be able to use undercover agents and cooperators, or get help from international that track the sources of viruses and cyber-weapons.

In the absence of such assistance, investigators would have to trace the source of the attacks themselves. First, the infected computers must be located. For investigators in the United States, this technological challenge also presents a legal hurdle: obtaining subpoenas for multiple providers. Then, once the infected computers are tracked down, and if the owners don’t voluntarily turn them over, investigators face another legal obstacle: getting a search warrant to examine the hard drives. Only then can they begin the complex forensic analysis aimed at tracing the program back to its source.

The U.S. Computer Fraud and Abuse Act imposes another hurdle, albeit a minor one: The government must show that the alleged computer crime caused losses in excess of $5,000 over a one-year period. In this case, that would be easy to do. But so far, no evidence has emerged to suggest that any of the companies targeted by Operation Payback suffered serious losses. MasterCard, for example, said in a statement that while it had “seen limited interruption in some web-based services,” its “core processing capabilities have not been compromised and cardholder account data has not been placed at risk.” Prosecutors may feel less urgency to bring charges because the damages appear to be relatively small.

In contrast, the federal government last year won a conviction against Albert Gonzalez, an American who pleaded guilty in connection with the computer hacking of several major U.S. retailers. More than 40 million credit and debit card numbers were allegedly stolen in the process. Gonzalez was sentenced to 20 years in prison in March.

David Goldstone, a former attorney in the Justice Department’s Computer Crime and Section and now a partner at Goodwin Procter, said that a decision whether to prosecute the Operation Payback could come down to the allocation of resources and the perceived importance of the attacks. “The government may give it less of a priority,” Goldstone said. “They may treat it as graffiti.”

XBIZ: Top Adult Industry Newsmakers of 2010

27d5e939495dcca9b6f19a0ec2f347c5 XBIZ: Top Adult Industry Newsmakers of 2010

It’s been quite a year in the adult entertainment biz, and we’re ready to move on to the next. But let’s first take a look at the top newsmakers of 2010.

3D
2010 ushered in a frenzy of 3D TVs and the use of the technology in mainstream films making the transition into adult both as pioneering technology and a way to bolster lagging DVD sales. Productions have sprung up around the world including “firsts” from Italian director Tinto Brass, Hong Kong producers and of course domestically from studios Hustler, Vivid, New Sensations, Digital Playground that created a virtual 3D world on the web and Smash Pictures’ new 3D logos. Playboy has even announced its first-ever 3D centerfold.

ABBY WINTERS
After a four-month hiatus, natural girl producers Abbywinters.com burst onto the E.U. scene from Australia landing in its new Amsterdam offices. The company released new shoots from Amsterdam on its special 10-year anniversary site and managed to update18 of its sites during the move.

ADAM & EVE
In its 40th year as one of the premier brands in adult, Adam & Eve kicked off the year by winning Feature Movie of the Year at the 2010 XBIZ Awards for “The 8th Day.” Later in the year the company re-signed contract girl Alexis Ford to another exclusive contract while parting ways with its long-time contract performer Bree Olson. Adam & Eve also launched a sex-positive radio ad campaign featuring Mr. Marcus and began distributing movies for the popular reality-porn studio Shane’s World.

ADULTCON
Adult consumer expo Adultcon was hit with a lawsuit by rival Exxxotica claiming that it was cybersquatting on 19 domain names that were similar sounding to Exxxotica. On a more positive note, the expo and adult marketer D-Money’s Marketing Firm partnered to create new sponsorship packages to attract Internet companies.

ADULT DVD EMPIRE
The online retail giant removed the restrictions and licensing processes that come with downloading videos online in 2010 that made its site more user-friendly. It also removed the download-to-own restrictions on its video partner studios’ entire catalogs of movies. The company also debuted its own “AdultEmpire” VOD-only site with a ‘search within results’ search box that lets users drill deep into lists for exact results. Parent company Right Ascension was fined $78,000 and put on two years’ probation after pleading guilty to mailing four “obscene” videos to an Erie, Pennsylvania address.

ADULT FRIENDFINDER
Parent company of Penthouse magazine and mega-dating site AdultFriendFinder, Friendfinder Network made the news this year indefinitely pulling its own $240 million IPO plans citing poor market conditions. In July it made a $210 million bid for Playboy that was initially rejected and recently received $551 million capital infusion to embark on what CEO Marc Bell calls “three big initiatives.” In September, a California appeals court ruled that FriendFinder Network couldn’t compel Epic Cash (a competitor) to arbitrate its claims over litigation involving Zango’s pop-up advertising. The suit stems from a long-running battle over Internet marketing and the alleged FFN conversion of Zango pop-up ads and traffic to benefit its business.

ADULT TALENT MANAGERS
Adult Talent Managers and A-List Talent Management announced a merger that made it one of the largest talent agencies in adult entertainment. Adult Talent Managers owner Shy Love, who is also a performer and director, has nearly 10 years experience in the adult, while A-List owner September Dawn entered the business in 1994 and soon established herself as the go-to wardrobe stylist for numerous top producers. Their company now operates as Adult Talent Managers and is headquartered in Studio City.

ADULT WEBMASTER EMPIRE
AWE produced a public service announcement (PSA) for ASACP last year that featured Adult Webmaster Empire-Lalib Marketing Support Group’s program director Mickey Bojcsik for the Restricted to Adults (RTA) Website Label. The PSA features Bojcsik reminding companies to protect children and to protect their business by labeling with RTA and is available for viewing on YouTube.com/ASACPRTA. “AWE’s support of ASACP has been vital to our ability to help protect children online,” ASACP CEO Joan Irvine said.

AEBN
VOD giant AEBN began an exclusive content juggernaut securing a number of major producers including Metro Media, Immoral Productions and Smash Pictures. It also inked deals with gay companies Treasure Island, BoyCrush and Factory Video. Some of the company’s technology highlights included the rollout of its RealTouch haptic device to the public at Exxxotica last May and the introduction of its Silverlight Media Player that eclipsed the use of RealPlayer among its users and added a boost to its HD theater presentations.

AIDS HEALTHCARE FOUNDATION
The Los Angeles-based proponents of mandatory condom use in XXX productions and legislation to protect adult movie performers made headlines by launching legal complaints with local health departments in Miami and Los Angeles this year. Citing the safety concerns of adult film workers, the organization’s president Michael Weinstein targeted Hustler for producing 100 condom-less films and mounted a public protest against the company. An HIV scare in October also prompted the AHF to ask the L.A. City Council to stop adult productions in the city.

AMY FISHER
The notorious tabloid star became a professional porn star in 2010, signing an exclusive two-year deal with Dreamzone Entertainment. The agreement called for the New York native to star in eight hardcore movies over the next two years. She made her official debut in “Deep Inside Amy Fisher,” which was released in October.

ANDROID
Google’s Android operating system made a significant run at the Apple iPhone market in 2010 fueled primarily by its features, apps and buying options. And it’s “porn friendly” app development posture made it a welcome alternative to Apple’s no porn policy. In fact, even Apple co-founder Steve Wozniak said he believes the product will dominate the global market.

APPLE

Whether it’s “Getting Levi’s Johnson” or “Jersey Score,” Jet Set had the savvy to strike fast, giving the fans two of the most memorable entries of the year. And with the debut of JetSetMen.TV last month, the company is staying atop the technology curve.

JIMMYJANE FORM
When Kelly Cutrone, Bravo TV star and high-profile publicist, gifted Jimmyjane products while on her press tour in Los Angeles, a mainstream media blitz ensued. Cutrone gave Chelsea Handler, host of E! Network’s “Chelsea Lately,” a FORM 2 Waterproof Rechargeable Vibrator, as well as a Little Gold Silent Waterproof Vibrator — which she noted was “Kate Moss and Dita Von Teese’s favorite vibrator.” Cutrone also brought the products to her appearance on Ryan Seacrest’s KIIS FM radio show, and the two discussed the unique shape of FORM 2. In the summer, Jimmyjane unveiled FORM 3.

JOANNA ANGEL
Continuing her reign as adult’s alt-superstar, Joanna Angel’s marketing savvy yielded DVD releases in conjunction with Vouyer Media, sponsorship of “The Hardcore Meets Hardcore Tour,” featuring bands from Rise Records and Mediaskare Records, the creation of her company Burning Angel live cam site with PrivateCamZ and the debut of a print magazine bearing her name from Magna Publishing. Although her body graced a number of new video releases including a VOD horror and comedy spoof , the star also put her brain to work sitting on a Yale University sex panel with colleague Sasha Grey.

JOE FRANCIS
No stranger to controversy, Girls Gone Wild CEO Joe Francis was accused of attacking two of his female employees, one of whom is pregnant. He also went on the offensive, filing suit against a former employee — Ryan Simkin — who he claimed breached a non-disclosure agreement regarding a “tell-all” book deal. More troubles hit when a Los Angeles Superior Court Judge threw out a defamation lawsuit he brought against Playboy Playmate of the Year Jayde Nicole stemming from a fight at a West Hollywood, Calif., nightclub in 2009.

JOHN JACOBS (Drake Rock Media)
Company videographer John Jacobs completed his acquisition of gay content producer Drake Rock Media. “I have been directing and filming for the Drake Rock Media since the beginning,” Jacobs said. “This acquisition allows creative control over all aspects of the company, from booking and directly interacting with the talent, to editing and marketing the final product.”

JOHN STAGLIANO
Evil Angel’s John Stagliano, Evil Angel Productions and John Stagliano Inc. were charged by the U.S. government with seven counts of obscenity in 2010, stemming from the mail and Internet distribution of two movies “Milk Nymphos,” directed by Jay Sin; “Storm Squirters 2,” directed by Joey Silvera; and a trailer from Belladonna’s “Fetish Fanatic 5.” The case was ultimately dismissed last summer, thanks in part to inept federal prosecutors who failed to meet the burden of proof, but the Washington trial took on national interest with Stagliano appearing on a number of news outlets including FOX News’ cable TV show hosted by John Stossel. Outside the courtroom, Stagliano, perhaps joking, said he was “disappointed. [The government] didn’t put up much of a fight. They were sloppy and not passionate and doing the prosecution for the wrong reasons.” He added, “And karma is important.”

JRL
The gay adult industry publication JRL held its first annual Gay Film Awards on Sept. 19 at the Catch One Disco in Los Angeles. The attorney’s new firm, Walters Law Group includes current associate, Kevin Wimberly. Walters also formed an “of counsel” relationship with Jennifer Kinsley, who practices in Cincinnati with partners Louis Sirkin and Scott Nazzarine. “The move is just a natural progression for my growing practice,” Walters said. “I am staying in my current office location and maintaining my brand name of FirstAmendment.com in my new practice.” Walters has been vocal about the issue of “sexting” this year, claiming it’s not criminal and not child porn but rather a social problem. “Sexting is the modern equivalent of students passing love notes to each other in class. Teens communicate with each other electronically more often than verbally. These communications are sometimes erotic, and that is human nature.”

Producer/director Lee Roy Myers in July announced the formation of his new studio Nightingale, which specializes in lesbian porn and released its first title “Miss Conduct” through Adult Source Media. Myers also helmed “The Human Sexipede,” the darkest, most twisted parody of his career for Tom Byron Pictures. It drew significant mainstream attention due to the cult classic status of “The Human Centipede.”

The designer brand of intimate products captured the attention of mainstream this year with an expanding collection of non-graphic-looking toys that crossed over via a New York-based gynecologist named Dr. Andrew Scheinfeld, who began selling LELO products out of his office, which was later reported on by Elle magazine. Off camera, he announced a move into publishing with the launch of Black Diamonds through an agreement with Blue Horizons.

The rift between Hustler founder Larry Flynt and brother Jimmy Flynt continued this year over ownership of LFP. Jimmy Flynt filed suit in Ohio, claiming among other things that he’s a partner in LFP and was instrumental in keeping the company afloat after Larry Flynt’s medical problems resulting from the 1978 assassination attempt. At that time Larry Flynt said his brother has no equity position or stock in the multimedia empire. The case was recently dismissed by the Ohio judge who said the proper venue for the court battle is California and not Ohio. Jimmy Flynt’s attorneys said they still believe Cincinnati is where the case should be litigated. “The fight will go on,” Jimmy Flynt’s attorney Robert Hojnoski said. “They’re partners now and they were partners then and we intend to prove that.”

Borden and her Extreme Associates partner, Rob Black, entered a guilty plea on obscenity charges in 2009. The case has been waged for much of the decade and began when an undercover U.S. Postal Service inspector bought porn videos through Extreme Associates’ membership site in 2002.

LUKAS RIDGESTON AND BEL AMI
While his own line (distributed by EuroMedia) was the talk of the town, the house Lukas helped build was still going strong. Bel Ami has helped turned its star model into a star director through its online wing. And there’s a reason the colorful studio wins awards for best marketing — its fun, athletic twink is perhaps the strongest brand ever built, and the company has introduced a few dirty surprises over the years to keep things fresh. 2010 saw both of their names grow even stronger.

The company also acquired Spankwire and took over EuroRevenue after it closed its doors in March. Its copyright infringement battle with Ventura Content, parent of Pink Visual Productions, ended in a settlement in October. As part of the agreement, Manwin has agreed to implement — and is already testing — the copyright filtering software offered by Vobile Inc., on its various tube site properties. But more trouble arose when Corbin Fisher parent Liberty Media Holdings filed suit against tube site Spankwire.com, operated by Manwin Canada, for copyright infringement. It also produced an anti-piracy PSA video. Other actions included a Pink Visual-hosted anti-piracy retreat and an anti-piracy bill passed by U.S. Senate that gives government agencies the power to go after foreign and domestic website infringers. The measure has the backing of several leading entertainment companies, groups and corporations but it also has critics like the Electronic Frontier Foundation, which called the bill “Internet censorship” that could harm the credibility of the U.S. and U.S. Sen. Reality Kings said the movie did not use FAMU students or property but ultimately settled with the college paying $105,000 to fully fund two scholarships in addition to $15,000 in attorney fees. As accessible and friendly as they come, the former reality TV star — who charmed viewers during the 10th season of Big Brother on CBS in 2008 — made waves with his transition to porn in “Steven Daigle XXXposed,” one of the most talked-about films of the year. He’s worked with the best and shown a few different sides to his sexuality to keep things fresh. An appearance on Bravo’s “Real Housewives of Atlanta” (and an unfortunate arrest at a viewing party) have kept him in the headlines.

STORMY DANIELS
The award-winning, Louisiana-born performer/director announced on April 15 that she would not run for the U.S. Senate seat held by then-embattled David Vitter. (CNN) — U.S. agencies have warned some employees that reading the classified State Department documents released by WikiLeaks puts them at risk of losing their jobs. But what about students considering jobs with the federal government? Do they jeopardize their chances by reading WikiLeaks?

It’s a gray area, said professors and experts who spoke with CNN. The topic has been debated intensely in the past week in legal and academic circles, ever since several U.S. universities sent e-mails to students with warnings about reading leaked documents.

They say students ought to be mindful of their future careers when commenting on or distributing the documents online — especially those planning to seek jobs in national security or the intelligence community, which require a security clearance.

“The security clearance asks whether or not you’re a risk when it comes to sensitive material. This could be one indicator that, when taken together with others, creates a broader pattern that might suggest you’re not a person to be hired,” said Pepperdine University law professor Gregory McNeal, who specializes in national security law.

“They may very well take into account your opinion, as a job candidate, whether or not you think WikiLeaks is a good thing or bad thing for the country,” he said. “It’s a small issue, but one to approach with caution if I were a student seeking a job in the national security field.”

E-mails went out last week to students at several schools, including Boston University’s School of Law, Georgetown University’s School of Foreign Service and Columbia University’s School of International and Public Affairs, cautioning students against commenting on or posting links to the documents on social media sites such as Facebook or .

Each message came from the schools’ offices of career services, claiming to be sent at the recommendation of an alumnus.

In the eyes of the federal government, the documents remain classified, “thus, reading them, passing them on, commenting on them may be seen as a violation of Executive Order 13526, Classified National Security Information,” said Maura Kelly, Boston University law assistant dean for career development and public services, in an e-mail to students.

“Two big factors in hiring for many federal government positions are determining if the applicants have good judgment and if they know how to deal with confidential/classified information,” Kelly said in the memo, which was posted on the law blog “Above The Law” last week.

A Boston University spokeswoman confirmed that the e-mail had been sent, adding that students are “free to make their own choices.”

“Our Dean of Career Development and Public Service thought it prudent to alert our students to the possible ramifications of dealing with classified information, especially in light of the fact that law graduates often apply for jobs that require security clearances,” Mary K. Gallagher said in an e-mail.

So, can just reading about the leaked documents in the media jeopardize your chances of getting a job with the federal government?

Probably not, said McNeal. But commenting on them online or distributing them might create a pattern of behavior that raises red flags during screening for the highest levels of security clearance, which often require polygraph tests.

“I don’t think looking at them alone could hurt anyone. The problem is when you’re looking and then supporting and endorsing, then you start running into trouble. That’s where you run the risk of jeopardizing the security clearance on character grounds,” he said.

It also serves as a reminder to be mindful of your “online and personal profile,” your virtual footprint of statements, comments and shared materials stored in the web’s collective consciousness, the professor said.

“When you’re up against so many others for the same competitive job, you don’t want to stand out for this. Prudence would dictate, don’t add another possible reason for them to ding you.”

Nor should the school’s warnings necessarily be construed as policy endorsement, said Harvard Law School professor Jonathan Zittrain, co-founder of the school’s Berkman Center for Internet & Society.

“I imagine the distribution of these warnings is less to endorse the policy and more just to say, ‘Hey this is what we’re hearing.’ This is not like advising students to not smoke pot. It’s not weighing in on a matter of policy. It’s just telling them that it might affect them down the road,” he said.

But to the government agency hiring you, there could be a big difference between just reading about the documents in the news and actively disseminating them or seeking them out in their full form on WikiLeaks’ site.

“It’s a new situation, and the documents are so ubiquitous right now that it seems weird to worry who on the margin has ever posted a link to them. But at the same time, the initial release was against the law, so I can’t begrudge the government, when figuring out who to employ or trust with secrets, to ask if you helped to further spread documents that belonged to the government.”

After the issue went viral last week on “Above The Law” and “the Arabist,” which posted an e-mail to students at Columbia University’s School of International and Public Affairs, the blogosphere lit up with comments from readers calling the practice unconstitutional and a violation of free speech rights.

Many suggested the warning was over the top and added another layer of anxiety for job-seekers in a weak job market. An unscientific survey on “Above The Law” asked readers what they thought: 55% said the warnings were needlessly scaring law students, 38% said a little over the top but a prudent thing to consider in a difficult job market and 9% said spot on, even reading the stuff could get you in trouble.

But would it be illegal for the State Department to deny anyone a job based on statements about WikiLeaks? The answer is unclear, but in the private sector, inquiries from prospective employers about your ability to handle confidential material would be considered “legitimate business concerns,” labor lawyer Camille Olson said.

“The framework of the issue goes back to whether the employer has a legitimate concern about your fitness for the position,” said Olson, a Chicago-based attorney who has represented large employers, including the U.S. Chamber of Commerce and The Society for Resource Management.

“I can understand how an employer in the federal government would believe that someone who once engaged in that kind of conduct, with the understanding that the information was confidential, how that reflects upon their potential for handling confidential info in the future.”

The e-mail from Columbia University’s School of International and Public Affairs told students that posting links or making comments about the documents online would “call into question your ability to deal with confidential information, which is part of most positions with the federal government.”

On Monday, the school issued a follow-up, saying that said it supported students’ right to “discuss and debate any information in the public arena that they deem relevant to their studies or to their roles as global citizens” without fear of consequences.

“OCS e-mailed this cautionary suggestion to students, as it has done many times with other information that could be helpful in seeking employment after graduation. We know that many students share a great deal about their lives online and that employers may use that information when evaluating their candidacy,” Dean John H. Coatsworth said in a statement.

“Should the U.S. Department of State issue any guidelines relating to the WikiLeaks documents for prospective employees, SIPA will make them available immediately.”

The U.S. government’s position on WikiLeaks has been clear since November 28, when the site began posting anonymously leaked U.S. State Department documents. The has condemned the disclosures, arguing that they harm U.S. diplomacy by exposing confidential communications. The site has been kicked off servers in the and France and lost a major revenue source on Friday when the U.S.-based PayPal cut off its account.

The White House Office of Management and Budget also sent a memo forbidding unauthorized federal government employees and contractors from accessing the classified documents on the WikiLeaks site or other websites on government or personal computers.

The memo, sent to federal workers and contractors without official federal government authorization to read the documents, said that just because the documents have been published on the internet does not change their “classified status” or “automatically result in declassification.”

“Classified information, whether or not already posted on public websites or disclosed to the media, remains classified, and must be treated as such by federal employees and contractors, until it is declassified by an appropriate U.S. Government authority,” the memo said.

What’s less clear is the government’s official position on whether potential recruits should avoid WikiLeaks. A spokeswoman for the Office of Management and Budget would not comment on the issue. But a look at the Standard Form 86 — the questionnaire all applicants for national security positions must fill out — sheds light on the risks the government wants to avoid.

Questions related to past associations, such as have you ever “knowingly engaged in activities designed to overthrow the U.S. Government by force” or “engaged in acts of terrorism” are intended to evaluate whether you could pose a security risk, said McNeal, the Pepperdine law professor.

The big concern for universities, which are supposed to be incubators for lively debate and the exchange of ideas, is the chilling effect the warnings may have, said Zittrain, the Harvard professor.

“I would hate to see the policy extended so broadly that you have students scared to read newspapers,” Zittrain said. “What I hope no one would want to do is ask if you read an article about the documents and hold that against you. They’re out there so it might be quite natural to read something about them.”

N. Korea incident prompts Obama, staff to shift priorities

03feac845c4645173e0356483c1f6137 N. Korea incident prompts Obama, staff to shift priorities

— President was awakened at 3:55 a.m. Tuesday to a fresh foreign policy problem: ’s deadly artillery against a South Korean island.

It wasn’t enough of a disaster to change Obama’s plans for the day — a trip to Kokomo, Ind., to talk about jobs and the economy and an interview with ABC’s Barbara Walters— but it prompted a scrambling of top national security aides in Washington, plans to call to South Korean President Lee Myung Bak and a new look at where North Korea sits on his administration’s list of priorities.

“Traditionally, North Korea has not been a top-tier problem, but events like this need to make it a much higher priority,” said Victor Cha, a Korea expert at the Center for Strategic and International Studies. “This is close to conventional war in Asia. This has to become a top-tier problem for the administration.”

EXPERTS: Korea conflict poses major risk for U.S.
VIOLENCE: N. Korea fires artillery onto S. Korean island; 2 dead

The response made clear the president and his advisers took the latest act of aggression from North Korea — the shelling of the tiny island of Yeonpyeong — seriously:

•On Air Force One, White House deputy press secretary Bill Burton told reporters that “the president is outraged” by North Korea’s aggression and committed to South Korea’s defense.

He said Obama was awakened by a phone call from national security adviser Tom Donilon.

The White House put out a statement condemning the attack about a half hour later, at 4:33 a.m.

•In the Situation Room at the White House, at least 20 of Obama’s top national security aides, including Defense Secretary Robert Gates and Secretary of State Hillary Clinton, convened at 4 p.m. ET to discuss the matter. Also at the meeting: Adm. Mike Mullen, chairman of the Joint of Staff, U.N. ambassador Susan Rice and James Clapper, the Director of National intelligence.

Obama dropped by the meeting when he returned from Kokomo.

• At the White House, Obama was scheduled to call Lee — who would just be waking up — at 9 p.m. ET to confer.

• In his ABC interview scheduled to air Friday, Obama said the threat from North Korea is “serious and ongoing” and “needs to be dealt with.” He urged China to to communicate to North Koreans “that there are a set of international rules they need to abide by.”

Burton said that “North Korea is not living up to their obligations and they ought to live up to the obligations signed in the armistice agreement” in 1953 at the end of the Korean War.

The communist regime also needs to halt its “illegal nuclear program,” Burton said, just days after Stanford University scientist Siegfried Hecker, a former director of the Los Alamos National Laboratory, reported that he had discovered a new uranium enrichment facility.

Janne Nolan, head of nuclear security programs at the American Security Project, a non-partisan think tank, and author of Guardians of the Arsenal: The Politics of Nuclear Strategy, said North Korea’s latest provocations are “not a crisis for Obama per se” but rather “an ongoing persistent problem that the international community has been trying to address for decades.”

On the nuclear issue, she said the shouldn’t be cowed. “We were ready to face down 10,000 nuclear weapons from the Soviet Union,” Nolan said. “We should be able to deal with North Korea.”

At the conservative Heritage Foundation think tank, Asian Studies Fellow Bruce Klinger said the Obama administration hasn’t put enough emphasis on the North Korea problem.

Obama has committed to Mideast peace talks that are “going nowhere” and a new arms-reduction treaty with that “has no advantages” for the , he said. In doing so, the administration has sent “messages to the Iranians and the North Koreans that they’re not at the top of his radar. … One could argue that that’s why they’re becoming so aggressive.”
