Judge Bites BitTorrent Lawyer in Butt

fe7d5a74be990d805159fd301cf83f3c Judge Bites BitTorrent Lawyer in Butt

District Judge Royal Ferguson has severed most of attorney Evan Stone’s remaining John Doe defendants, arguing improper joinder.

DENTON, Texas—Attorney Evan Stone may believe he was born to litigate copyright infringement cases on behalf of producers of adult content, but he’s having a hard time convincing U.S. District Judge Royal Ferguson that the tactics he is using to achieve that end are legal. Last week Ferguson, citing improper joinder, all but decimated most of the remaining cases Stone has filed in the Northern District of Texas. In 13 of the 16 cases, all of which originally targeted hundreds if not thousands of anonymous alleged John Doe offenders, only one unnamed defendant remains.

Defiant to the end and apparently beyond, Stone told CNET, “This isn’t over. There are numerous other tools for obtaining the names and addresses of pirates, and we’re not going to stop until justice is served.” He told the site the judge had “improperly” severed the defendants, and insisted that BitTorrent users must work together to achieve their file-sharing ends.

In one case, however—LFP Internet v. Does 2,619—Ferguson wrote, in his opinion severing all but one of the Does and quashing issued to ISPs, “Plaintiff makes no allegation in this case that the claims against the joined defendants ‘arise out of the same transaction, occurrence, or series of transactions or occurrences.’ Instead, it seems that the copyright infringement claim against each Defendant is based upon the individual acts of each Defendant. Plaintiff only alleges in its Complaint that each defendant uses the same method for committing the infringement, but ‘merely committing the same type of violation in the same way does not link defendants together for purposes of joinder.’”

Ferguson then referenced the fact that several courts have agreed that where there is no allegation that multiple defendants have acted in concert, joinder is improper. Indeed, Ferguson rejected outright the salient claim in these cases that the very use of BitTorrent software systems by end users ties them together in a conspiratorial act of piracy that is legally binding. If this is the prevailing view of judges regarding the behind BitTorrent sites, it is hard to see how any of these mass defendant lawsuits will survive.

The judge added one last slap down to his decision, ruling that even the subpoena for the final sole Defendant, Doe 1, should be quashed, “pending this Court’s determination that as to whether an attorney ad litem should be appointed to protect Doe 1’s interests.”

The federal Rule of Civil Procedure 21 does not allow the court to dismiss a case for improper joinder, so all of the 16 Stone cases remain alive, as long as individual complaints against the Does are filed within 30 days of the date of the order. It remains to be seen, of course, whether that will happen, but in the mainstream that is exactly what is happening.

According to CNET, Dunlap, Grubb & Weaver, a law firm that was also slapped down last year for trying similar tactics on behalf of the producers of The Hurt Locker, has begun to file individual lawsuits around the country.

“To do that,” wrote Greg Sandoval, “Dunlap established a network of lawyers who are licensed to operate in different federal districts.”

The firm has also begun filing lawsuits against named individuals, reported CNET, including suits filed in the U.S. District Court for the Southern District of West against residents who live there.

“Filing in in about 10 minutes,” Thomas Dunlap, one of the firm’s founders, e-mailed CNET Thursday. “I am driving to courthouse now, should have cases already in Illinois. We will file in California, Texas, Washington, and Oregon in the next two weeks.”

While penalties for copyright infringement convictions can go as high as $150,000 per violation, Dunlap will usually offer an alleged infringer the chance to settle out of court for an amount between $1,500 and $3,000. Attorneys filing on behalf of adult producers have cited similar amounts that they are offering alleged pirates, if and when they can get a hold of indentifying information.

Adult companies that Evan Stone has filed lawsuits on behalf of include LFP Internet Group, , VCX Ltd., Mick Haig Productions, Harmony Films, Adult Source Media, D & E Media, Serious Bidness, Steve Hardeman, Justin Slayer International and FUNimation Entertainment.

Most Google, Facebook users fret over privacy

Most Americans are worried about privacy and viruses when using or (GOOG), according to results of a USA TODAY/Gallup Poll released Tuesday.

Nearly seven out of 10 Facebook members surveyed — and 52% of Google users — say they are either “somewhat” or “very concerned” about their privacy while using the world’s most popular and dominant search engine.

Even so, technologists and privacy experts say most people lack a clear grasp of the complex risks they accept whenever they’re on the . “Consumers generally do not understand who’s getting access to their data and for what purpose,” says Ryan Calo, director of the Consumer Privacy Project at the Center for and Society.

Many of “have a general sense of unease” when we’re online, Calo says.

The poll found that a similar percentage of Facebook and Google users — 65% and 54%, respectively — say they are worried about Internet viruses.

“In my mind, that shows a lower level of concern (about viruses) than folks really ought to have,” says Lisa Sotto, head of privacy and information management at law firm Hunton & Williams. “There is probably a lack of understanding about how very dangerous viruses can be.”

The erosion of security and privacy often go hand in hand. Social networks, banks, tech companies and retailers continue to make it easier than ever to create accounts, share personal details and do most activities on the Web.

This is being driven largely by advertisers’ desire to make online pitches to the person most likely to buy. “The only way that happens is through the collection of huge amounts of data about each of us, followed by the sale of the data,” says Michael Fertik, CEO of identity management firm Reputation.com.

Data flowing through the Web have translated into a candy store for criminals. It’s easier than ever for even low-skilled hackers to spread infections via e-mail, Facebook and Twitter postings and corrupted Google search results. Risks are rising with the use of smartphones, tablet PCs and e-readers to access the Web.

Some companies are doing what they can. “I’m heartened by the attention to mobile privacy issues,” says privacy attorney Chris Wolf of Hogan Lovells. New services revolve around “ways to empower people to protect their information.”

Exclusive: U.S. asks about search fairness in Google/ITA

WASHINGTON (Reuters) – The Justice Department’s review of Inc’s planned acquisition of airline ticketing software company ITA Software is focusing on making sure ITA’s products remain available, even to ’s rivals, according to a source close to the deal.

Google’s proposed acquisition of ITA has sparked worries in the tech world that travel websites such as Orbitz Worldwide Inc, Kayak and TripAdvisor could be deprived of ITA’s software.

Kayak, for example, is asking for assurances that Google will extend its software licenses when they expire, that the software is upgraded and that a firewall is placed around the companies’ proprietary software, which operates in conjunction with the ITA software and may be in ITA servers, to protect their .

But Google has been unwilling to give them those assurances, said Kayak spokesman Robert Birge. “We have found the conversations with Google to be frankly wanting,” he told Reuters.

Google, the world’s No. 1 Internet search engine, announced plans to acquire ITA Software for $700 million in cash in July.

Tom Barnett, former chief of the Justice Department’s antitrust division who now represents Expedia, said it would be difficult to craft a settlement to take the licensing assurances and intellectual property protection into account.

“I’m not saying it’s impossible. I’m saying it’s difficult,” said Barnett, a critic of the deal.

But Robert Doyle, an antitrust expert at the law firm Doyle, Barlow and Mazard PLLC, said a focus on licensing would mean that the deal would go through.

“That’s a key issue,” he said. “That would indicate that settlement has been proposed in some format and they’re testing it.”

Google has argued that since it does not compete against ITA Software, the deal would not affect in the online travel industry and, thus, is legal.

“We’re excited to inject more choice for consumers into the online travel space, and while we continue to cooperate with the Justice Department’s review, we are ultimately confident that this acquisition will increase competition,” said Google spokesman Adam Kovacevich.

A Justice Department spokeswoman declined comment on the investigation.

LOOKING AT MANIPULATED SEARCH RESULTS?

Early in the probe, the Justice Department’s antitrust division asked questions about allegations that Google favored certain websites in searches, sources close to the deal said.

Foundem, a British price comparison , is one of several companies that have accused Google of manipulation results so that Foundem and other rival websites show up lower in search results. Users overwhelmingly tend to click on higher results.

Time Warner Says No to Massive Outing of ‘Does’ in LFP Lawsuit

Instead of fighting the cable companies, LFP decided to end its contract with Dallas-based attorney Evan Stone, in part because of his ‘unprofessional’ tactics

DALLAS— Cable did not actually refuse to turn over identifying information about users of its accused of illegally downloading Hustler’s This Ain’t Avatar XXX, but the offer by the provider (ISP) to provide ten disclosures a month amounted to pretty much the same thing, as far as Evan Stone, the Dallas-based attorney who orchestrated the LFP and several other similarly themed John Doe cases, was concerned.

“If you’re a pirate in these times,” Stone told Monday, “TWC is the ISP to have.”

Stone wanted to push back against the decision by TWC, but he told CNET that LFP asked him to back off, and that in light of their disagreement over tactics, the two have decided to part ways. According to LFP, however, it was Stone’s “unprofessional” tactics that persuaded them to end the contract in the first place.

LFP v Does 1-635 was filed Sept. 17 in District Court in Dallas, and like other recent lawsuits targeting anonymous users of BitTorrents, the assistance of ISPs is an essential ingredient in the success of the cases, or at least the financial settlement negotiations that take place between the law firm and the end users accused of pirating copyrighted content. If the ISP refuses to cooperate, as happened in this case and has also happened in mainstream cases, the studio is unable to connect the IP address associated with the alleged piracy to a human being.

The pushback by TWC in the LFP case cannot have been totally unexpected by Stone, however. Earlier this year, according to ZeroPaid, the cable operator and ISP told the , D.C.-based Copyright Group—in John Doe cases involving the indie movies Steam Experiment, Far Cry, Uncross the Stars, Gray Man and Call of the Wild 3D—that it could not reasonably handle more than 28 IP address lookups per month.

“TWC told the USCG that the thousands of IP address subpoenas it submits are on top of the hundreds per month it already receives, virtually all coming from law enforcement, and some being ‘emergency requests in which death or serious physical injury are at issue.’ It said responding to all of the USCG’s subpoenas would require it to ‘redirect substantial resources away from compliance with law enforcement requests,’” reported CNET.

The USCG cases involved more than 20,000 alleged infringers, far more than the 635 anonymous users sued in the LFP case. That TWC offered Stone and his 635 alleged infringers ten lookups a month seems reasonable on its face considering the accumulating burden on the ISPs to do lookups, even if it would have taken 63 months to complete the task.

According to LFP President Michael Klein, however, the shifting focus from the alleged pirates to putting pressure on the cable companies was not a strategy that appealed to the iconic company, which has a television division and continuing global ambitions that require it to be a partner rather than an antagonist with companies like Time Warner.

In pointed comments made late Tuesday while he was still on vacation, Klein said that as much as LFP is determined to maintain a professional relationship with cable operators, it was ultimately their frustration with Stone’s aggressive PR tactics that led them to the decision to end the contract with him.

“He wanted us to put pressure on the cable operators, but it’s not our goal to go after them,” Klein told AVN. “We want to look at ways to go after pirates, and we thought this strategy might work out, but the reason why we terminated with Stone was because of what we considered to be his unprofessional tactics.”

Klein added that while Stone’s ongoing pressure to increase the use of PR tactics was off-putting to LFP and finally fatal to the lawsuit, it was the manner in which the attorney dealt with LFP’s decision to end the contract that was particularly galling.

“We terminated the contract quietly and then he immediately goes to the press. Why would he do something like that?” asked Klein, rhetorically, adding that Stone’s decision to do so “proved our point and justified the reason why we [parted ways].”

For his part, Stone expressed to CNET a characteristic self-confidence regarding a legal strategy that requires a willingness to play hardball not only with alleged infringers but also with ISPs that remain resistant to exposing the identities of thousands of their customers. It is a resistance that makes increasing sense in a market in which more and more people are flirting with the idea of cutting the cable.

ISP push back is but one obstacle facing lawyers employing the massive John Doe strategy, but Stone remains adamant that he will succeed where others have failed. Just ten days after a West Virginia judge issued a series of orders that upended the seven lawsuits brought by attorney Kenneth Ford and his Adult Copyright Company by ‘severing’ all but one of the John Doe defendants in each of the cases, Stone insisted to CNET that the same thing will not happen to him.

“Stone said the suits he has filed stand a better chance than [mainstream law firm] Dunlap or Ford’s,” reported CNET. “While he saluted their attempts, Stone was critical of their methods. He said there wasn’t enough evidence in Ford or Dunlap’s filings to sufficiently tie the defendants together. The firms also filed in unfriendly courts, according to Stone.

“In the complaints he filed, on behalf of such adult-film studios as Vivid and Mick Haig Productions,” the article continued, “Stone said he shows that all the defendants helped each other obtain pirated copies of the same movie.”

Stone added that with the sole exception of LFP, all of his other clients want him to “go to the mat” in his battle with not only the alleged infringers but also the ISPs.

“I was born for [these kind of cases],” Stone said. “I put myself through school doing database programming and I earned a film degree before my law degree. I honestly think it’s my tech background that has saved me from making the same mistakes [Dunlap and Ford] made. Either way, this trend of BitTorrent litigation is a long way from over.”

Time will tell, of course, whether Stone’s birthright is indeed the factor that allows his cases to prevail when the others hit a legal brick wall, or whether the Electronic Frontier Foundation and others are correct in their assessment that these massive John Doe lawsuits represent a violation of due process for the thousands of thus-far-anonymous end users who remain utterly ignorant of the fact that they are being collectively rounded up by Evan Stone and other copyright posses.

Productions have sprung up around the world including “firsts” from Italian director Tinto Brass, Hong Kong producers and of course domestically from studios Hustler, Vivid, New Sensations, Digital Playground that created a virtual 3D world on the web and Smash Pictures’ new 3D logos. Playboy has even announced its first-ever 3D centerfold.

On a more positive note, the expo and adult marketer D-Money’s Marketing Firm partnered to create new sponsorship packages to attract Internet companies.

ADULT DVD EMPIRE
The online retail giant removed the restrictions and licensing processes that come with downloading videos online in 2010 that made its site more user-friendly. It also removed the download-to-own restrictions on its video partner studios’ entire catalogs of movies. The company also debuted its own “AdultEmpire” VOD-only site with a ‘search within results’ search box that lets users drill deep into lists for exact results. Parent company Right Ascension was fined $78,000 and put on two years’ probation after pleading guilty to mailing four “obscene” videos to an Erie, Pennsylvania address.

ADULT FRIENDFINDER
Parent company of Penthouse magazine and mega-dating site AdultFriendFinder, Friendfinder Network made the news this year indefinitely pulling its own $240 million IPO plans citing poor market conditions. In July it made a $210 million bid for Playboy that was initially rejected and recently received $551 million capital infusion to embark on what CEO Marc Bell calls “three big initiatives.” In September, a California appeals court ruled that FriendFinder Network couldn’t compel Epic Cash (a competitor) to arbitrate its claims over litigation involving Zango’s pop-up advertising. The suit stems from a long-running battle over Internet marketing and the alleged FFN conversion of Zango pop-up ads and traffic to benefit its business.

ADULT TALENT MANAGERS
Adult Talent Managers and A-List Talent Management announced a merger that made it one of the largest talent agencies in adult entertainment. Adult Talent Managers owner Shy Love, who is also a performer and director, has nearly 10 years experience in the adult, while A-List owner September Dawn entered the business in 1994 and soon established herself as the go-to wardrobe stylist for numerous top producers. It also inked deals with gay companies Treasure Island, BoyCrush and Factory Video. Some of the company’s technology highlights included the rollout of its RealTouch haptic device to the public at Exxxotica last May and the introduction of its Silverlight Media Player that eclipsed the use of RealPlayer among its users and added a boost to its HD theater presentations.

AIDS HEALTHCARE FOUNDATION
The Los Angeles-based proponents of mandatory condom use in XXX productions and legislation to protect adult movie performers made headlines by launching legal complaints with local health departments in Miami and Los Angeles this year. Citing the safety concerns of adult workers, the organization’s president Michael Weinstein targeted Hustler for producing 100 condom-less films and mounted a public protest against the company. An HIV scare in October also prompted the AHF to ask the L.A. City Council to stop adult productions in the city.

AMY FISHER
The notorious tabloid star became a professional porn star in 2010, signing an exclusive two-year deal with Dreamzone Entertainment. The agreement called for the New York native to star in eight hardcore movies over the next two years. She made her official debut in “Deep Inside Amy Fisher,” which was released in October.

ANDROID
Google’s Android smartphone operating system made a significant run at the Apple iPhone market in 2010 fueled primarily by its features, apps and buying options. And it’s “porn friendly” app development posture made it a welcome alternative to Apple’s no porn policy. In fact, even Apple co-founder Steve Wozniak said he believes the product will dominate the global smartphone market.

APPLE
The computer giant launched the iPhone4 and iPad tablet, both of which stirred the porn pot for adult producers. But despite early attempts to capitalize on the popular iPhone platform, Apple quickly pulled the plug on all adult apps last April when CEO Steve Jobs made it clear to concerned customers that there would be no porn apps developed for the device. Although porn apps were forbidden, video chat found its way onto the iPhone4 and a number of adult companies have developed iPad-compatible websites that fit well with its large format screen and high resolution.

ASACP
The Association of Sites Advocating Protection (ASACP) continued its valued efforts on a number of fronts. The organization bolstered its international stance with a Spanish language website, reported that its pornography reporting hotline surpassed 500,000 reports, updated its Best Practices for Mobile Adult Sites and Mobile Applications, produced Restricted to Adults (RTA) public service announcements and site labeling and issued its comprehensive “Hotline Report: Online Pornography Data and Analysis” white paper. ASACP CEO Joan Irvine also announced the promotion of Tim Henning to vice president of technology and forensic research.

ASHLYNN BROOKE
The Oklahoma native and former New Sensations contract girl continued her transition behind the camera, inspiring Mile High Media to launch a new Hardcore Parody studio to showcase her promising directorial efforts. She kicked off the studio’s creation with the release of “Red Riding Hood” starring Lexi Belle and followed that up with directing Tori Black in a parody of “Wonder Woman.” “She’s actually an amazing director,” Mile High VP Jon Blitt said. “She’s very conscientious.”

AXEL BRAUN
The reigning XBIZ Director of the Year for a Body of Work upped the ante this past year, producing and directing several more critically acclaimed parodies, a few of which were grandiose in scope. Braun inspired the Vivid Superheroes line with his superb “Batman XXX” parody, and then later directed the wildly ambitious “This Ain’t Avatar XXX 3D” for Hustler Video, “This Ain’t Glee XXX” and numerous other hit spoofs.

BACI LINGERIE
Baci Lingerie officially launched during April’s International Lingerie Show in Las Vegas where the company flaunted its new collection with over-the-top marketing that included dominating the show with promotional videos, posters, giveaways and a massive booth. With plans to establish distribution partners on each continent, the company in August named Avelli its exclusive U.S. distributor.

Details of the plea were unavailable but sentencing was scheduled for Nov. 29.

BITTORRENT SUITS
In a wave of anti-piracy action multiple domestic and international adult content producers have filed thousands of lawsuits against John Doe bit torrent pirates in 2010, many of which are being filed by Chicago attorney John Steele’s Media Copyright Group. The companies include ’s LFP, Axel Braun Productions,West Coast Productions, Combat Zone, Third World Media, Patrick Collins Inc., Lightspeed Media Corp., Grooby Productions, Titan Media, Corbin Fisher, Michael Lucas Productions, Hard Drive Productions. CP Productions Inc., First Time Videos and Future Blue Inc. German porn producer Mick Haig Productions has filed suit against 670 pirates.

BLUEBIRD FILMS
Bluebird was one of the talks of the town all year, sparing no expense on two of the biggest budget movies in adult history — “Bat FXXX: Dark Night” and “Bonny & Clide.” Just “Bat FXXX” alone was an incredible achievement in special effects and stunt coordination for an adult movie. One of the questions for 2011 is what will Bluebird owner/producer/actor Paul Chaplin and CEO/director Nicholas Steele do for an encore?

BOBBIE EDEN
Sex, social networking and sports converged into a frenzy of interest when Dutch adult star Bobbie Eden promised her Twitter followers a blowjob if her home country of the Netherlands had won the World Cup against rival Spain. The star posted her promise on June 28 in simpatico with fellow stars Vicky Vette and Miss Hybrid who made the same promise if their countries (the U.S.A. and England respectively) had won their games. Guccione and his third wife, Kathy Keeton, who died in 1997, launched several other magazines, including Longevity, Viva and Omni. He also produced or financed several motion pictures, including “Caligula,” “Chinatown” and “The Longest Yard.” Guccione also was a world-renowned art collector.

BOXEE
Trying to edge out other web streaming TV set-top box devices and help catapult sales, Boxee announced its own store last summer to sell access to adult pay-per-view and subscription programs and channels. Boxee already had Pink Visual and Bang Bros on board and is banking on more adult companies signing on to access the company’s network of more than 800,000 users. Boxee CEO Avner Ronan said the new platform is just one more way for the Internet to compete against traditional distribution models. “The Internet represents a great opportunity for the major media companies and for the independent content producers to create more engaging and immersive experiences around their content and for them to be paid for more eyeballs on yet another screen. The connected living room represents a new medium, one in which great value could be generated.”

BRAINCASH
The marriage of online and video production studios continued as leading affiliate program provider Braincash partnered with top studio Elegant Angel Productions and launched ElegantAngel.com. The twisted indie thriller “Trick of the Witch” closed the Los Angeles International Independent Film Festival in November; and the thriller “Crumble” made its world premiere in July at the New York International Independent Film and Video Festival. Meanwhile, Andrews ended a three-year retirement from performing to star in Lee Roy Myers’ “Sex in the City” parody for New Sensations.

CALIFORNIA EXOTIC NOVELTIES
In addition to participating in the Emmy gifting lounge, where the company got the opportunity to introduce its line of products to celebrities, CalExotics saw its Sexpert program flourish to 100 qualified bloggers worldwide and nearly 1 million views each month. Additionally, the company’s partnership with BMS Factory led to the birth of CalExotics’ luxury brand, Vanity.

CAL/OSHA
California worker safety watchdog Cal/OSHA took center stage of the ongoing mandatory condom debate that included the adult industry, AIDS Healthcare Foundation (AHF), AIM and the Free Speech Coalition. The organization agreed to examine the state labor code by appointing a panel of concerned members to examine section 5193 of the state’s safety regulations. A Cal/OSHA-formed subcommittee included adult industry attorney Paul Cambria, FSC representative and industry regulatory expert Kevin Bland, Hot House Entertainment CEO Steven Scarborough, Evil Angel General Manager Christian Mann, Traci Bryant, Dan Leal, Chase, Peter Kerndt, Paula Tavrow, Denise Bleak, Gail Bolan and Frank Strona. COLT STUDIOS
COLT Studio’s founder Jim French made an attempt to regain control of the company he sold to Prowest Media Corp. in 2003. French Studios attorneys tried to force COLT into Chapter 7 bankruptcy last September claiming it hasn’t been paid the bulk of a multimillion-dollar promissory note related to the sale of the company. French is attempting to take over the company as it controls the voting power of the unsecured class of creditors.

Internet payment service provider CommerceGate added Mac & Bumble and Twistys to its portfolio of sites in 2010. The international processor also became one of The Association of Sites Advocating Child Protection (ASACP) newest Corporate Sponsors.

CORBIN FISHER
Gay studio Corbin Fisher flexed some legal muscle going after DVD pirates the company alleged manufactured hundreds if not thousands of nearly 136 company videos. The company was surprised at the “old School’ DVD counterfeiting crime but nevertheless asked for tens of millions of dollars from the defendants and eventually won a $990 judgment. The company also went after content pirate site PornILove.net offering a $1,000 reward for information on the principals. In addition, it sued tube site TnAFlix.com and settled with two companies after bringing cyber-piracy and trademark infringement charges against a number of sites that tried to hijack its name.

FREE SPEECH COALITION
Fighting against the government’s revised 2257 record-keeping rules, mandatory condom use, content piracy and the ICM’s proposed .XXX sTLD kept the Free Speech Coalition busy in 2010. Although a federal judge denied the group’s motion to reconsider a previous decision, which threw out FSC’s 18 U.S.C. §§2257 and 2257A lawsuit against the federal government, it vowed to appeal the move. On a more positive note, the FSC’s Anti-Piracy Action Program (APAP) spawned a widely viewed PSA video and showed significant promise documenting about 287 million views on 1,700 tube-site videos identified with its spidering software. All told, 18 adult production companies participating in APAP have fingerprinted more than 5,000 titles with the software to track content and gather data from infringing tube sites in its first three months. The group continued its opposition of the .XXX sTLD and has challenged the ICM Registry’s bid for ICANN’s acceptance of .XXX. After completing testing for two generations of partners of the so-called Patient Zeta, AIM said that all performers tested negative for HIV on two occasions using multiple testing methods. ICM REGISTRY
At the center of the .XXX sTLD initiative and controversy (with some opposition from the adult industry) is Stuart Lawley, CEO of ICM Registry, the organization pushing for the adoption of .XXX as the domain designation of choice for the adult industry. Lawley petitioned the ICANN body this year with a registry contract after ICANN initially rejected .XXX. Lawley began selling the .XXX suffix in hopes that ICM would be the gatekeeper for the sTLD. Lawley also bought the domain name DotXXX.com for $25,000 for advertising purposes, redirecting visitors to its official site, ICMRegistry.com. The ICM Registry also created the slogan, “Let’s Be Adult About It,” which will appear along with DotXXX.com in all future media campaigns. ICM also owns DotXXX.com, LetsBeAdultAboutIt.com and LetBeAdultAboutIt.com, all of which redirect to ICMRegistry.com as well. The ICM Registry’s contract is now out for approval. JOE FRANCIS
No stranger to controversy, Girls Gone Wild CEO Joe Francis was accused of attacking two of his female employees, one of whom is pregnant. He also went on the offensive, filing suit against a former employee — Ryan Simkin — who he claimed breached a non-disclosure agreement regarding a “tell-all” book deal. More troubles hit when a Los Angeles Superior Court Judge threw out a defamation lawsuit he brought against Playboy Playmate of the Year Jayde Nicole stemming from a fight at a West Hollywood, Calif., nightclub in 2009.

JOHN JACOBS (Drake Rock Media)
Company videographer John Jacobs completed his acquisition of gay content producer Drake Rock Media. “I have been directing and filming for the Drake Rock Media since the beginning,” Jacobs said. “This acquisition allows creative control over all aspects of the company, from booking and directly interacting with the talent, to editing and marketing the final product.”

Outside the courtroom, Stagliano, perhaps joking, said he was “disappointed. [The government] didn’t put up much of a fight. They were sloppy and not passionate and doing the prosecution for the wrong reasons.” He added, “And karma is important.”

Teens communicate with each other electronically more often than verbally. These communications are sometimes erotic, and that is human nature.”

Jimmy Flynt filed suit in Ohio, claiming among other things that he’s a partner in LFP and was instrumental in keeping the company afloat after Larry Flynt’s medical problems resulting from the 1978 assassination attempt. At that time Larry Flynt said his brother has no equity position or stock in the multimedia empire. The case was recently dismissed by the Ohio judge who said the proper venue for the court battle is California and not Ohio. Jimmy Flynt’s attorneys said they still believe Cincinnati is where the case should be litigated. “The fight will go on,” Jimmy Flynt’s attorney Robert Hojnoski said. “They’re partners now and they were partners then and we intend to prove that.”

The case has been waged for much of the decade and began when an undercover U.S. Postal Service inspector bought porn videos through Extreme Associates’ membership site in 2002.

LUKAS RIDGESTON AND BEL AMI

Its copyright infringement battle with Ventura Content, parent of Pink Visual Productions, ended in a settlement in October. As part of the agreement, Manwin has agreed to implement — and is already testing — the copyright filtering software offered by Vobile Inc., on its various tube site properties. But more trouble arose when Corbin Fisher parent Liberty Media Holdings filed suit against tube site Spankwire.com, operated by Manwin Canada, for copyright infringement. The suit, filed at in Alexandria, Va., targets two individuals — Shadi Barakat and Milia Abi Azar — as well as their Lebanon-based — Flowers Lebanon Delivery — which marketed the dating site RedTubes.us, now inoperable. At its height, RedTubes.us was drawing nearly 8,000 visits a day.

Over time, Bright Imperial pared down the suit, which originally included demands for damages, to only include Anticybersquatting Consumer Protection Act claims because of issues relating to locating and establishing jurisdiction.

But after legal notices were sent by and mail, as well as a public notice published in an adjudicated newspaper, operators of RedTube.us never showed up to challenge the matter in court.

Bright Imperial counsel Thayer Preece, of the firm Sheppard, Mullin, Richter and Hampton, did not immediately respond to XBIZ for comment on the case.

Media Copyright Group’s John Steele: Pirate Slayer

bbe4c08ea8e12e3da5984cf3c3833db4 Media Copyright Group’s John Steele: Pirate Slayer

CHICAGO—John Steele is a Chicago-based attorney whose main practice focuses on the conventional areas of law, and consumer bankruptcy. But like a caped-crusader, he has extended his legal aspirations into the relatively new and aggressive arena of copyright infringement lawsuits targeting anonymous infringers who obtain their content from Torrents. While certainly not the only attorney to stake a claim in this area, his Media Copyright Group has seen a lot of action lately on behalf of clients that might not necessarily utilize the services of his “daytime” firm: production studios.

Steele is already well into three lawsuits on behalf of adult studios—Hard Drive Productions, Lightspeed Media, and Millennium TGA—and he told AVN that several more are being prepared. The litigious floodgates are wide open, his legal guns are locked and loaded, and as the following interview makes clear, the crosshairs are now centered squarely on the illegal downloader.

You have three lawsuits filed already. Are there more coming down the pike?

Yes, we have about ten lawsuits in various stages of readiness, including three more we will be filing tomorrow morning on behalf of new clients, with larger numbers of John Does, probably closer to a thousand.

Your approach is to file suit, enter discovery and obtain the identifying information of the alleged infringers and then try to negotiate a settlement with them. Could you subpoena ISPs for that information before filing a ?

No, you have to have an underlying cause of action in order to issue discovery and a subpoena is just one part of discovery.

What happens after you get the identifying information from the ISP? Do you attempt to negotiate with each and every one of the alleged infringers?

Yes, we attempt to reach out to everybody. We get a certain small percentage of people who say, ‘Hell no, we’re going to hire an attorney and fight it,’ and we say, okay, that’s fine, and just proceed along. Of course, statutory figures are in the six figures, so usually that’s just bravado on their part. Other people want to work something out or begin a process of verifying the information that we have, and we understand that, too. People want to make sure about their chances of winning (or losing) before entering into a settlement. We’ll always work with people. Just the other day, a guy said, ‘Okay you got me, but I don’t have the money to pay you off in one lump sum, can I pay it off in three payments?’ We said, sure. We want to minimize the effect of this on everyone. Even if they brought it upon themselves, there’s no reason to make a mountain out of a molehill.

You mentioned six figures? Are most of the targeted people multiple offenders or are some of them people who downloaded once or twice?

First, I would bet—though I don’t have any proof—that everyone we’ve gone after is a multiple offender, but we only go after people for one violation that we have caught them doing. There are certain statutory damages that are allowed under U.S. Copyright law, and the damages can go up to $150,000. But there is a range [of fines], and in the end it depends on the judge and the judgment and a lot of factors, but it can go up that high.

How seriously do you take the security of the data or identifying information of accused illegal downloaders? I’m thinking of the British law firm in trouble for allowing similar information to be stolen by hackers.

I would first say that to the extent that any law firm doesn’t protect the data in keeping with whatever statute there is, they are liable for bad conduct. I don’t necessarily blame them for having their data stolen because obviously that happens to a lot of companies. But yes, we take data security very seriously, and we protect the data that is sent to to the best of our ability.

Do ISPs send you the information about these people in encrypted form?

No, they usually do not. There is no requirement that I am aware of that they have to do anything other than simply mail us the information. We get much more incriminating information from other lawsuits all the time. Besides, the name and phone number of someone who has an IP address is just one little piece of the entire evidence puzzle.

What about the people who simply deny that it was them doing the downloading, or that you got the wrong IP address, or that sort of thing?

We are not like the recording industry in that we get a lot of false positives; in fact, I don’t believe we’ve had a single one. Our software is very advanced; it’s all customized and proprietary, so we have an amazing amount of incriminating data and information about each one of the people we’re going after. By the time we have had a conversation with these people, they have long since stopped denying that they did it, let’s just put it that way.

On another note, I read a study recently that said 99 percent of all BitTorrent content is illegal, so I have a real problem when people say they didn’t know it was illegal, or people saying we’re picking on people downloading. It’s like the Napster argument. We all know that when you get a hundred million dollar movie like Batman for free because you went to this sketchy looking that didn’t have anybody’s ownership on it, you know that’s not legitimate. If you’re going to argue that you didn’t know, you’re like the guy who gets pulled over for speeding and says he didn’t know. Well, too bad, you were speeding, and our legal system says that ignorance is no defense.

I’ve had a lot of conversations with people who have called the office and said, ‘Oh, this is what happened, my son downloaded it, or whatever.” Well, the court system here thankfully puts the responsibility on the car driver for the purposes of speeding tickets, and on the owner of the ISP account for the purpose of illegal downloading. In almost all contracts with internet service providers, people promise not to engage in illegal activity with the bandwidth that the ISP provides them, and the ISP then gives them dynamic IP addresses that change every two days or so.

The technology sounds new. Are these basically test cases for the effectiveness of your technology in court?

All I can say is that the technology we have does make it practically impossible to have a false positive, but obviously the details are a trade secret. Regarding whether or not the evidence will hold up in court, our and experience shows us that because of the way it is compiled and the way the data is grabbed from the defending party, we don’t see how there could be any argument to exclude it. Obviously, if the evidence is excluded, we don’t have much to present to the court that the person is a defender, but thus far the courts have ruled in our favor on almost every issue relating not only to our evidence but also our right to find out the identities of the offenders.

Why are all of these adult cases happening now?

I think part of it is that there were some decisions handed down in the District of Columbia that made it easier for these lawsuits, but I also think the technology has caught up with the problem. It took us nine months to develop our software, but since the beginning of the year we’ve realized that for the first time the legal precedent exists to be able to go after multiple John Does at the same time, and also to obtain their information through the ISPs.

Once we made the porn studios aware that we might be able to assist them, it was basically the beginning and end of our marketing effort, because quite frankly I doubt I go three days without a studio asking us to work with them. We haven’t made a call to a studio since the first week that we started working on this project.

What is your strategy with respect to naming alleged infringers publicly?

Well, as you know, we are only naming people in the lawsuits as anonymous John Does. We don’t put any person’s real name in there until it becomes apparent that we can’t work anything out. My attitude is, let’s try to resolve this with the least amount of litigious behavior. I was just speaking to someone yesterday and he said, ‘Look, I want to resolve this, I work with the Boy Scouts, I didn’t download anything inappropriate or illegal.’ He didn’t want to deal with the problem and have to hire an attorney, and we were able to resolve the issue and come to a resolution. In that case, no one is ever going to know his name other than our staff, and we much prefer that, because we don’t think anyone is served by losing their job or being ridiculed or whatever.

At the same time, if our clients have had content stolen from them and they lost money because of it, we have to protect their rights. I think it’s a balancing act between making sure people are not embarrassed but also make sure our clients don’t go out of , because it’s a free-for-all right now on the internet.

Do you recognize that there are some people in the industry who don’t agree with the tactic of suing people who watch porn, using basically the same argument the music industry faced when it started suing illegal downloaders?

Yes, of course, I’ve heard this argument made a lot, but I have to respectfully disagree with the people who say we’re going after [the industry’s] customers. People who are very comfortable using BitTorrent and taking content for free are not going to ever pay for it. Our research is very clear on that point.

Our argument is very basic. We believe that using Torrent sites to watch copyrighted content is theft, and we are just going after the people who do that so they can compensate our clients for stealing something. It’s like we’re going after a car thief. We don’t care that it’s a car that’s a certain color or brand; we’re going after him because he stole a car.

There are also a lot of people in the mainstream who don’t believe in going after end-users, because it somehow lessens the freedoms inherent in the internet.

In fact, it is by allowing pirates to simply bankrupt or at least cripple this entire industry that reduces freedoms by preventing the law-abiding citizen from getting access to content. At this rate there won’t be any high quality, high-definition porn, but only recycled stuff from the 80s and 90s, because it will no longer worth it to make new movies.

What about the claim that was made in the Yahoo! News article that implied you want to shame illegal downloaders publicly for the type of content they are watching as part of the strategy to get them to settle?

I think it’s muddying the water to say that we’re trying to shame someone; it’s an effort to take people’s eye off the ball, because at the end of the day unless you can confuse people it boils down to the fact that someone stole something that wasn’t theirs. And that’s something that I think people can understand, and certainly so far the judges have no problem understanding that. Quite frankly, I’m surprised at how fair the judges have been. I have absolutely never felt in any of these cases that the judges were not giving us the full protection of the law because of who we happened to represent.

Here’s how we look at the issue. Some of our producers make content that some people may not feel is mainstream content, such as transsexual content. But our clients believe in their content. They’re not embarrassed by the fact that they make it, and they’re certainly not embarrassed that people come and pay them for it. But I do think that any upstanding citizen would and should be embarrassed to go into federal court to defend illegally downloading Titanic, because he committed a crime and if he gets a judgment against him and works at a bank or for the government, he could have trouble at his job. So there’s always an embarrassment factor when you’re caught breaking the law and that’s what we’re going after.

In the larger sense, I can’t speak to what a downloader may or may not feel embarrassed about because when I download porn I’m not embarrassed about it at all. I did it, I want to watch it and if you don’t like it, well, I guess you don’t have to be my friend. I would be personally offended if someone were to come to me and say, John, you can’t watch transsexual content. Excuse me, but we’re in the United States. I want people to have complete freedom.

I just think it’s important to get back to the basic issue here. We have to prove that these people stole something. If we make an allegation in federal court that we have no way of proving, we’re going to get in a lot of trouble. So the accused is defending himself on an action that we have a lot of evidence that he did. If he’s that embarrassed about downloading porn, then maybe he shouldn’t do it, but that’s a separate issue. The fact is, I don’t care what he downloaded. If he downloaded Rosetta Stone to learn to speak Spanish; if he downloaded Titanic; if he downloaded transsexual porn; if he did any of these downloads illegally and he’s caught, he should be punished according to the U.S. Copyright statutes.

In light of your success in the courtroom thus far, do you expect to hear from any mainstream studios?

We actually have received a couple of calls from studios out in California, but we’re not sure if we’re going to go in that direction. We are very busy right now with the clients we have, and I’ve always believed it’s dangerous to worry about your next client and not about your current client. But yes, our technology would allow us to go after any illegal downloader of anything, and the only limiting factor would be our ability to scale up.

So why do you think some law firms—like the one litigating The case—are having more difficulties than you are? A federal judge in South Dakota just blocked their attempt to get information from ISPs in the state.

A part of that may have been about how they went about doing it. Litigation doesn’t have to be about shouting at one another and being hostile. If you go to third parties that are just trying to make money providing internet service or whatever, and you act like a jerk with them, they may not like that. We try to work with third parties and don’t see the upside in threatening them or throwing lawsuits around at the people we need as partners in this. I mean, I don’t think ISPs want to be a conduit to massive bandwidth usage for illegal purposes because they would then have to increase their infrastructure. Illegal downloaders hurt ISPs as much as anyone else. So we point that out to them, and say, if you lose one tenth of one percent of the people who are mad because we’re suing them, you’re also going to get rid of 80 percent of your client problems, at which point you can send us a thank you card.

Privacy Group Targets Law Firm for Porn Data Breach

930f05d2799507c76a8a219ca8c584d8 Privacy Group Targets Law Firm for Porn Data Breach — Tens of thousands of users’ personal email information was reportedly leaked from British anti-piracy law group’s ACS:Law’s on Friday.

As a result, U.K. and U.S.-based watchdog group, Privacy International (PI) is preparing to take action against ACS:Law claiming its efforts to mount a breach of campaign against users accused of illegally sharing porn content exposed vital information.

The glitch — said to be the result of poor server administration and lack of security — made the names, addresses, postal codes, IP addresses and even credit card information of more than 10,000 users available for download that reports said is estimated to be in the “hundreds of thousands.”

PI cited the Data Protection Act, which prohibits sensitive data from being stored on a public website and said that unencrypted emails were stolen from the ACS:Law website on Friday evening while the systems were being subjected to a string of distributed denial-of-service (DDoS) attacks by the online pirate collective Anonymous.

The Anonymous campaign began last Tuesday when the group responded to attacks by anti-piracy groups on the file-sharing website The Pirate Bay. The collective then launched its own salvo against a variety of firms and associated with the war on online .

The initial targets were the Motion Picture Association of () and (RIAA) websites as well as British law firms ACS:Law and Davenport Lyons.

Reports said that Anonymous renewed its attack on ACS:Law on Friday after the company’s top lawyer, Andrew Crossley, was quoted as saying he was less concerned about the first attack than he was about his train turning up late or having wait in line for coffee.

When ACS:Law restored its website following this second assault, it inadvertently exposed a backup of its emails and according to PI, Anonymous then made three months of email work available through The Pirate Bay.

“This data breach is likely to result in significant harm to tens of thousands of people in the form of fraud, identity theft and severe emotional distress,” PI advisor Alexander Hanff said.

He added, “This firm collected this information by spying on users and now it has placed thousands of innocent people at risk.”

It has been speculated that PI has been gunning for ACS:Law because the law firm is being investigated by the U.K.’s Solicitors Regulation Authority for its letter writing campaigns that demand in exchange for not taking the recipient to court for their alleged copyright infringements.

But PI’s Hanff denied that the privacy group’s outrage was related and said, “There’s no bias here at all.”
