Sponge Babe? Sexy Halloween garb gets weirder

Have you recently walked into a costume store and felt overwhelmed by the stripper-friendly getups? By now, Halloween shoppers are accustomed to being bombarded by risqué nurse and cat outfits, but this year’s selection seems like someone sexed up the encyclopedia. You’ll notice a strange range of characters reinterpreted in new, flashy ways — the scantily clad cave girl, a scandalous “Tin Woman” from Oz, sassy Captain America, barely-there “Ghostbuster,” “Sponge Babe” and even a sexy giraffe. It couldn’t be more arbitrary than if a preschooler picked their favorite toys and animals. While Halloween has often been more an excuse to dress inappropriately than to display one’s creativity, one could applaud costume makers’ provocative spin on previously untouched territory. At CostumeSuperCenter.com, the “Eskimo Sexy Cutie” costume comes complete with a crushed velvet minidress, a chocolate Popsicle prop and white mittens for the “igloo-dwelling ingénue,” which is ridiculous (everyone knows Eskimos eat Akutaq ice cream, not Popsicles). And while green has certainly become a growing trend, a “Sexy Environmentalist” disguise (Buycostumes.com) features a “Recyclers Do It Twice” pin, in case anyone questions the consistency of their habits. These are obviously tongue-in-cheek, but they also seem unnecessarily erotic. It’s as if Halloween requires all costumes be sexy, and we’re now extending it to every interest, hobby and occupation. There are even degrees of sexiness now. If a midthigh skirt isn’t meeting your expectations, you can opt for “super sexy” versions of once-innocent fairy-tale characters. Snow White can be taken from sassy to nearly naked just by using less fabric. Your Prince Charming? Turns out he’s a sucker for spandex. And not to exclude the men, sexy male costumes include elves and gynecologist characters. Is this a “30 Rock” sketch? Sky.tv Omits Adult Channels on New XBOX Service

LOS ANGELES — Sky.tv, an online entertainment service, has inked a deal to deliver content to the XBOX 360, but the company has yet to include porn in that deal. Microsoft's XBOX 360 offers a variety of video content, including many channels from providers like Sky.tv, which is calling its channel the Sky Player service, which will replicate the video offerings of its online presence. Except for adult. As of now, Sky.tv offers three adult channels: Television X, Adult Channel and the Playboy Channel. None of those channels will be available through the Sky Player service on the XBOX 360. Sky.tv’s Griff Parry didn't rule out the possibility of the channels coming to the XBOX, he said it wasn't likely. "No plans at the moment," he said. "I suspect it's quite unlikely. Mary Beth Buchanan Finally Calls It Quits

PITTSBURGH—In the wake of yet another scandal, Mary Beth Buchanan, the U.S. Attorney for the Western District of Pennsylvania, today gave her "two weeks notice" that she will resign from her job effective Nov. 16. Buchanan, who was appointed to her position shortly after Sept. 11, 2001, brought the first federal obscenity case in more than a decade when she indicted Extreme Associates owners Rob Black and Lizzy Borden on April 8, 2003 for interstate transportation of obscene material and posting obscene material to a website. Buchanan followed up that "coup" by indicting agoraphobic invalid Karen Fletcher on Sept. 26, 2006 for having posted allegedly obscene stories to her website, which at its height had just 29 subscribers. In the end, Black, Borden and Fletcher all pled guilty. Black and Borden each received sentences of one year and one day in prison, while Fletcher, because of her fear of leaving her home, was sentenced to six months home detention and five years of probation. As one of the more conservative U.S. Attorneys (USAs), Buchanan was one of the original "loyal Bushies," and in June of 2004, she was rewarded by then-Attorney General John Ashcroft with the post of Director of the Executive Office for United States Attorneys at the Department of Justice, which she performed in addition to her USA duties. As Director of the Executive Office, Buchanan provided administrative support to the 94 United States Attorneys' offices across the country, and also served as a liaison between the U.S. Attorneys and other federal agencies and Department of Justice components. However, charges later surfaced that Buchanan had been one of the Bush administration officials to recommend to Attorney General Alberto Gonzales' assistant Kyle Sampson which USAs would be fired in order that they could be replaced by even more conservative prosecutors. Also, in that position, Buchanan hired Regent University Law School grad Monica Goodling as her assistant. It was Goodling, in a later position as the Attorney General's White House liaison, who proceeded to fill staff positions at the Justice Department with conservatives—no Democrats needed even to apply—and blocked the appointment of a federal prosecutor based on rumors that the woman was a lesbian. As the USA for Western Pennsylvania, Buchanan was also responsible for the 2003 prosecution of comedian Tommy Chong for having financed his son's company, Chong Glass/Nice Dreams, which sold bongs and other "drug paraphernalia" over the internet. Chong eventually pled guilty and spent nine months in federal prison—and it only cost taxpayers a little over $12 million to do it! But perhaps Buchanan's biggest blunder was her attempt to prosecute popular Allegheny County Coroner Dr. Cyril H. Wecht, a prominent Democrat, for allegedly using his staff and the resources of the Coroner's Office to run personal errands for him, and to provide funds and services for his private pathology practice. Facebook Gets $711 Million Judgment Against "Spam King"

SAN JOSE, Calif.—It isn't the largest monetary award Facebook has ever won in court, but the second largest at a cool $711 million. Not that the social networking phenomenon will see even a majority of the money Sanford Wallace (pictured) was ordered to pay Thursday for spamming the social network. Wallace was sued by Facebook in February along with two co-defendants for obtaining the login credentials for other FaceBook accounts, which were then used to send spam to those users' friends starting around November 2008. Sam O'Rourke, lead council for litigation and intellectual property at Facebook, wrote in a blog post Thursday: "Today, a San Jose, Calif., court awarded Facebook $711 million in damages against Sanford Wallace, one of the spammers who accessed people's accounts without their permission and sent phony Wall posts and messages. While we don't expect to receive the vast majority of the award, we hope that this will act as a continued deterrent against these criminals. "Most notably, the judge referred Wallace to the U.S. Attorney's Office with a request that Wallace be prosecuted for criminal contempt, which means that in addition to the judgment, he now faces possible jail time. This is another important victory in our fight against spam. We will continue to pursue damages against other spammers." Last year Facebook won $873 million from a Canadian who was caught spamming pharmaceuticals and sex products. While these judgments would seem to imply that the spammers are on the defensive, and maybe even losing the war, not everyone thinks the multimillion-dollar awards translate into intimidation for a breed of scammer accustomed to playing the long shot in a high-stakes numbers racket. "Spamming is a lucrative business," writes Brennon Slattery for PC World, "and as long as e-mail accounts exist, spam will persist. While the judgment against Wallace will surely cause some spammers to second-guess their vocations, it's doubtful that it will put a serious dent in a profession so rife with money. Philly radio station Wired 96.5 will give Susan Finkelstein and her husband two tickets for Game 3 in Philadelphia between the Phillies and the New York Yankees, TV station MyFoxPhilly reported Wednesday. Game 3 is Saturday and will be broadcast on FOX. Susan Finkelstein says she's embarrassed about her arrest, but did nothing wrong. "I didn't do anything wrong, so I'm not embarrassed about my actions. I'm embarrassed about how I was arrested," she told The Associated Press in a phone interview on Wednesday, a day after meeting at a suburban bar with an undercover police officer responding to an ad on Craigslist. Finkelstein's lawyer said his client was merely "a nice lady overcome with Phillies fever." She might have dropped double entendres in her Craigslist ad but never explicitly offered sex, her lawyer William J. Brennan said. The 43-year-old Finkelstein wanted to take her husband to a game between her beloved Phillies and the Yankees. The self-described "buxom blonde" said she was simply trying to score tickets online, as she had in the past. Over a few beers at a suburban bar, she told a police officer she needed two tickets, one for herself and one for her husband. No price had been discussed, and Finkelstein and her lawyer stopped short of recounting specifics of what was said before several officers sitting at a nearby table came to arrest her. Motorola Rolls Out Droid Mobile Device

NEW YORK — Motorola has unveiled the adult-friendly Droid mobile device, which they're positioning as a challenger to the iPhone. The tech company has been promoting the Droid with an extensive ad campaign that targets everything the iPhone can't do, but the Droid can, such as run simultaneous apps. The Droid can do this because it runs on the Android OS, Google's entry into the mobile marketplace. The web should be accessible to everyone. Access to the services, commerce and entertainment on the web is a civil right just like access to the pathways, shopping and entertainment in physical spaces. Do laws support this idea that access to the web is a civil right that everyone can enjoy? Section 508 and the ADASection 508 of the Workforce Rehabilitation Act as amended in 1998 requires that the websites of Federal agencies be accessible. Section 508 has no direct bearing on public, non-government websites. But Section 508 has indirect effect on the accessibility of public information technology, as was the intent of the law. There is a robust set of accessibility standards developed as part of Section 508. Those standards serve to define accessibility of information technology. The idea is that companies will develop accessible technology to sell to the government and then use that same technology for all customers. When web development companies write accessible websites for federal agencies, they will be able to use the same techniques and practices for all clients. The Americans with Disabilities Act (ADA) is a civil-rights law that prohibits discrimination against people with disabilities. In particular, the ADA requires that places of public accommodation and the services they provide be accessible. Many believe the ADA applies to the web, as well as to brick-and-mortar establishments. In 1996, the Justice department issued a legal opinion that the ADA applied to the web. In 2004, New York State Attorney General Elliot Spitzer brought an action against Priceline and Ramada asserting that the inaccessibility of their websites violated the ADA. Note that Priceline.com has no bricks-and-mortar presence, while Ramada obviously does. That case did not go to court, and the two companies agreed to a settlement under which they assured the attorney general that they would make their websites accessible. Another case is often referenced as one that held the ADA did not apply to the web. In a Florida court, a group of blind people sued Southwest Airlines, asserting that because Southwest's website was not accessible, there were benefits for doing business on the site that were not available elsewhere and the site was a "place of public accommodation" just like a brick-and-mortar store, Title III of the ADA applied to Southwest.com. The District Court in Florida dismissed the suit, and it was appealed. On appeal, the plaintiffs argued that Southwest.com was a "travel service" and thus, subject to ADA. The appellate brief and oral arguments didn't even allege that Southwest.com was a "place of public accommodation." The Appellate court didn't rule on the travel service idea because it had not been raised in the District Court. The court didn't rule on the public accommodation issue because the appeal didn't raise that issue at all. The appellate court dismissed the appeal on procedural grounds. 9th Circuit: Obscenity Should Be Defined by U.S. Community Standards

SAN FRANCISCO — In a ruling of particular interest to online adult businesses, a federal appeals court has decided that a national community standard to define Internet obscenity is more appropriate than a local one. The ruling by the 9th U.S. Circuit Court of Appeals affirmed fraud, conspiracy, obscenity and money-laundering convictions and sentences for Jeffrey Kilbride and James Schaffer, but remanded to the lower court for correction three counts described as felonies as misdemeanors. A three-judge panel weighed a joint appeal of the first convictions in the jurisdiction of the 9th Circuit for Internet obscenity not involving child pornography and the first convictions ever under the federal CAN-SPAM Act. The appellants’ arguments focused on an unconstitutional jury instruction that allowed a jury in Arizona to convict Schaffer and Kilbride of obscenity based on lay witness testimony as to community standards existing in places all over the U.S. On Wednesday, the court agreed with Kilbride and Schaffer’s contention that a national standard is more appropriate for Internet communications and that the lower court failed to instruct the jury to that standard. “Our holding that application of a national community standard to define Internet obscenity does not raise grave constitutional doubts on its face is not to be interpreted as a holding that any constitutional challenge to such application will necessarily be meritless,” the court said in its ruling. The opinion, written by Judge Betty Binns Fletcher, also said that the 9th Circuit panel's decision joins U.S. Supreme Court Justices O¹Connor and Breyer's holding that "a national community standard must be applied in regulating obscene speech on the Internet, including obscenity disseminated via email." Gary Jay Kaufman of The Kaufman Law Group and Greg Piccionelli of Piccionelli & Sarno — attorneys for Schaffer and Kilbride respectively — argued the case before a three-judge panel of the 9th Circuit. Piccionelli said he was glad that the 9th Circuit to made this long-overdue change in obscenity law. "It has been clear to those of us practicing in the Internet law area for the last 15 years that the old formulation of letting the most conservative communities in America dictate what is or is not obscene on the Internet is deeply destructive to our fundamental freedoms," Piccionelli told XBIZ. Kaufman told XBIZ that the ruling was a pyrrhic victory for the appellants because their convictions still stand. “While the court agreed that a national standard was proper, the justices affirmed Schaffer and Kilbride’s convictions, holding that because their former trial counsel [who were not their appellate counsel] had failed to properly object at trial, the error was not ‘plain’ and therefore did not require reversal,” he said.
